Terms of Sale

These Terms of Sale govern all photography services and print orders provided by Magdalena Martin.

1. Booking & Agreement

A booking is confirmed only once:

• The agreement has been signed
• A 30% non-refundable retainer has been received

Magdalena Martin reserves the right to decline or cancel bookings at her discretion prior to confirmation.

2. Payment Terms

A 30% non-refundable retainer is required at the time of booking to secure the session date.

The remaining balance is due on or before the day of the session, unless otherwise agreed in writing.

In case of cancellation, the retainer is non-refundable.
In case of rescheduling, the retainer may be transferred to a new agreed date.

Late payments may incur additional fees.

All prices are stated in Euros unless specified otherwise.

3. Cancellations & Rescheduling

For private clients:

• More than 14 days before session: the deposit may be transferred to a new date
• Less than 14 days before session: deposit is non-refundable

In case of weather or force majeure, rescheduling will be offered when possible.

For commercial assignments (agencies, brands, corporate or institutional clients):

• Cancellations made 30 days or more prior to the scheduled date: no additional fee beyond deposit.
• Cancellations made 15–29 days prior: 30% of the agreed fee becomes due.
• Cancellations made 8–14 days prior: 50% of the agreed fee becomes due.
• Cancellations made less than 7 days prior: 100% of the agreed fee becomes due.

*Cancellation fees are calculated based on the total agreed fee.

Travel and accommodation expenses already incurred are non-refundable.

4. Delivery

Final edited images are delivered in high-resolution JPEG format.

RAW files remain the exclusive property of the photographer and are never delivered.

Edited images are archived at the photographer’s discretion. Long-term storage is not contractually guaranteed.

5. Image Rights & Licensing

All photographs remain the intellectual property of Magdalena Martin.

Clients receive personal usage rights only, unless a separate commercial license is granted.

Commercial usage, advertising, publication or brand usage requires prior written authorization and may be subject to licensing fees.

6. Minor Clients

For sessions involving minors, a legal guardian must provide written consent.

The guardian is responsible for ensuring contractual compliance.

7. Prints & Fine Art Sales

Fine art prints are produced with professional print laboratories.

Due to the custom nature of print production, prints are non-refundable unless damaged upon delivery.

Ownership of a print does not transfer copyright.

8. Force Majeure

Magdalena Martin shall not be held liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to:

• Extreme weather conditions
• Governmental restrictions
• Travel disruption
• Illness
• Venue closures
• Events qualifying as force majeure under French law

In such cases, rescheduling will be proposed whenever possible.

9. Limitation of Liability

The photographer shall not be liable for indirect or consequential damages arising from the use of the services.
